What are the Federal laws that regulate the Telemarketing industry?

Answer:
Two Federal laws govern the activities of telemarketers, the Telephone Sales Rule (TSR) administered by the Federal Trade Commissions and the Telephone Consumer Protection Act (TCPA) administered by the Federal Communication Commissions. The regulations under both laws were recently amended to include a new National DNC (Do Not Call) list.
 

Are there exemptions to these laws?

Answer:
If someone asks you not to call them, it has always been good practice to comply. Since October 1, 2003, this has been a legislative requirement in the United States, with fines up to $11,000.00 per incident for failing to comply.

There are exemptions to the national DNC register:

  • if a consumer makes a marketing inquiry, they can be called for three months. 
  • if there is an established business relationship, they can be called for 18 months from the last transaction date.

There are a number of steps that companies must take to ensure that they have a "safe harbor" for honest mistakes.
 

Call Center/Agent Call List Checking
